At Devil’s Harvest Seeds, we want you to have clear information about your rights when purchasing from our website.
This policy explains your statutory rights under applicable Dutch and EU consumer law, as well as our procedures for returns, refunds and defective products.
1. Your statutory right of withdrawal
If you are a consumer purchasing from our website, you generally have a statutory 14-day right of withdrawal for online purchases.
You do not have to give a reason for exercising this right.
For products, the withdrawal period normally begins on the day after you, or a person designated by you, receives the goods. Where an order is delivered in multiple parts, the period generally begins after receipt of the last product or part.
The right of withdrawal also applies to discounted or sale products unless a specific statutory exception applies.
2. How to exercise your right of withdrawal
You can exercise your right of withdrawal by clearly informing us that you wish to cancel your purchase before the withdrawal period expires.

You do not have to use a particular form of wording. Your communication must simply make it clear that you wish to withdraw from the purchase.
Once you have notified us of your decision to withdraw, you must return the goods to us without undue delay and, in any event, within 14 days after notifying us of your withdrawal.
3. Returning the goods
Please contact us at info@devilsharvestseed.com before sending a return so that we can provide the appropriate return instructions and return address.
Goods should be returned securely packaged and, where reasonably possible, in their original packaging.
You are responsible for the direct cost of returning goods when exercising your statutory right of withdrawal, provided that we informed you of this obligation before your purchase.
We recommend using a tracked delivery service and retaining proof of postage until your return has been processed.
4. Condition of returned goods
You may handle and inspect the goods to the extent necessary to establish their nature, characteristics and functioning, in a manner comparable to how you could reasonably inspect them in a shop.
You may be responsible for any diminished value resulting from handling beyond what is reasonably necessary to assess the goods.
For products supplied in sealed packaging where opening the seal results in a statutory exception to the right of withdrawal, the right of withdrawal may not apply after the seal has been broken where permitted by applicable law.
Nothing in this section limits any statutory rights you may have in relation to defective or non-conforming goods.
5. Refunds
If you validly exercise your statutory right of withdrawal, we will refund the payments we have received from you for the cancelled purchase, including the standard delivery cost you paid for the original shipment.
If you selected a more expensive delivery method than the least expensive standard delivery option we offer, we are not required to reimburse the additional cost.
Refunds will normally be made using the same payment method used for the original transaction, unless you expressly agree to another method.
We will make the refund without undue delay and normally within 14 days after receiving your withdrawal notice.
However, where permitted by law, we may withhold the refund until we have received the returned goods or you have provided evidence that you have sent them back, whichever occurs first.
6. Partial returns
If you return only part of an order, the original delivery charge is generally not refundable where the law does not require it to be refunded.
For example, if you purchase several products and return only some of them, we are not required to refund the delivery charge for the original order where applicable law permits this.
7. Sale and discounted products
Discounted, promotional and sale products are not excluded from statutory consumer rights.
Where the statutory right of withdrawal applies, you may exercise that right regardless of whether the product was purchased at full price or at a discount.
Any voluntary return period offered by Devil’s Harvest Seeds is additional to, and does not replace, your statutory rights.
8. Defective or non-conforming products
Your statutory rights relating to defective, damaged or non-conforming goods are separate from the right of withdrawal.

Where you have a valid statutory claim concerning a defective or non-conforming product, we will provide the remedy required by applicable law. Depending on the circumstances, this may include repair, replacement, price reduction or cancellation of the purchase and a refund.
We will not require you to pay costs that the law requires us to bear in connection with a valid statutory claim.
9. Orders we are unable to fulfil
If we are unable to fulfil an accepted order, for example because the ordered product is unavailable, we will inform you as soon as reasonably possible.
If you have already paid for an order that we cannot fulfil, we will arrange a refund in accordance with applicable law.

10. Products and local laws
Devil’s Harvest Seeds supplies cannabis seeds as novelty and/or souvenir items where permitted by applicable law.
The legal status of cannabis seeds, possession, importation, sale and germination varies between countries and jurisdictions.
We only ship to EU countries where cannabis seeds may lawfully be sold and imported, and we check the destination of every order before dispatch.
We do not represent that cannabis seeds may legally be imported, possessed, sold or germinated in every jurisdiction.
Nothing in this policy is intended to exclude or restrict any mandatory consumer rights that apply to your purchase under applicable law.
11. Statutory rights cannot be excluded
Nothing in this Returns & Refunds Policy limits, excludes or replaces any mandatory rights you may have under applicable consumer-protection law.
Where a provision of this policy conflicts with a mandatory legal right, the applicable legal right will prevail.
